2. The petitioner seeks bail in a case registered for the offences punishable under Sections 306, 506, 504/34 of the IPC in connection with Teghra P.S. Case No.200 of 2023.

The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that his brother had left the house at 4 p.m. in the evening on 26.06.2023 without informing anyone that as to where he is going and when he did not reach home till late in the evening, then all the family members started searching him and during search they came to know that he had gone near the gate of the refinery. Accordingly, they reached the refinery where they came to know that his brother had gone there with Bittu Kumar, accordingly, they reached the house of Bittu Kumar who

No.78669 of 2024(2) dt.17-01-2025 2/3 informed that he left for Teghra and thereafter it is alleged that 7 a.m. in the morning the next day, the dead body of the deceased was found lying near a government school, where a bottle and tablet of Sulfas was also found. It is further alleged that the deceased was in love with Ritu Kumari and when the parents of Ritu Kumari came to know about the said love affair they threatened the deceased as such based on suspicion, it is alleged that the deceased might have come to meet the daughter of the petitioner.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case being father of Ritu Kumari. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that from the place of occurrence a bottle and tablet of Sulfas was found which amply demonstrates that the deceased committed suicide. It is also submitted that informant is not an eyewitness to the occurrence and the entire allegation hinges around suspicion. It is further submitted that informant alleges that since deceased was in love with Ritu the same was objected by her parents and they had threatened the deceased, as such suspects that the petitioner along with others might have killed his brother.

5. The learned counsel for the petitioner next submits

6. The learned APP for the State opposes the bail application.

7. Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai in connection with Teghra P.S. Case No.200 of 2023.

8. However, in the event if the learned trial court comes to a conclusion that petitioner after being released on bail is trying to delay the trial in any manner, the trial court would be at liberty to cancel the bail bonds of the petitioner.
