Petitioners apprehend arrest in a case registered for the offence punishable under sections 395/397 of the Indian Penal Code.

As per the prosecution case, in the wee hours, 12 to 13 unknown miscreants came to the house of the informant, assaulted him and his family members and took away Rs.6 lacs Nepali currency.

Learned counsel appearing for the petitioners submits that the FIR is against unknown and petitioners' name has figured during course of investigation in confessional statement

Patna High Court CR. MISC. No.74395 of 2022(2) dt.05-05-2023 2/2 of co-accused. However, no incriminating material has been recovered from their conscious possession. Petitioners claim clean antecedent.

Considering the aforesaid facts of the case, prayer for bail of all the petitioners is allowed. In the event of arrest/surrender within six weeks from today, let these petitioners, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Benipatti, Madhubani in Madhwapur Police Station Case No. 51 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
