The petitioner in the present case is seeking regular bail in connection with Rajgir P.S. Case No. 266 of 2019 registered for the offences punishable under Sections 302, 201/120B of the Indian Penal Code.
Learned counsel for the petitioner submits that there is no eye witness to the alleged occurrence and except suspicion there is no material against him. It is further submitted that during investigation no one came forward to say that he has seen the occurrence.
Learned APP has opposed the prayer bail of the petitioner.
Considering the facts and circumstances of the case wherein it appears from the materials available on the record
Patna High Court CR. MISC. No.68513 of 2019(2) dt.04-12-2019 2/2 and the submissions of the parties, this petitioner was the tenant of the deceased and had been lastly seen with the deceased and in the confessional statement of the co-accused the entire modes operandi of the incident has been narrated by specifically pointing out the role played by this petitioner and the supervising authority has also found the case true against the petitioner, this Court is not inclined go grant privilege of regular bail to the petitioner at this stage. His prayer for bail is thus, refused.
Let the trial be expedited.
