The petitioner seeks bail in a case instituted for the offence under Sections-30(d), 30(a), 38, 47 of Bihar Prohibition and Excise Act, 2016.
Prosecution case, in short, is that 10 litres wine and 1200 kg. Mahua are recovered.
It has been submitted on behalf of the petitioner that petitioner is in custody since 07-11-2017 and has got no criminal antecedent. Charge-sheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses against the petitioners. It is alleged that 10 litres wine and 1200 kg. Mahua was recovered from different houses including house of the petitioner. There is no compliance of Section-100 Cr.P.C. On behalf of the State, it is submitted that petitioner is named in the F.I.R./complaint case.
Patna High Court Cr.Misc. No.14724 of 2018 (2) dt.15-03-2018 Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise Act, Gaya in connection with Barachatti P.S. Case No. 696 of 2017.
