====================================================== CORAM: HONOURABLE JUSTICE SMT. SONI SHRIVASTAVA ORAL ORDER 23-02-2026 Heard learned counsel for the petitioner, learned APP for the State and learned counsel appearing for the Opposite Party No.2.

2. The petitioner seeks bail in a case registered for the offence punishable under Sections 96, 352, 351 (3) and 3 (5) of B.N.S.

3. As per the prosecution case, petitioner along with the co-accused persons are alleged to have lured the minor daughter of the informant on pretext of marriage, with the intention of selling her.

4. Learned counsel for the petitioner submits that as many as four persons of the same family have been made an accused in this case with allegation of kidnapping the minor

There are general and omnibus allegations in the First Information Report and the present F.I.R was also lodged after an unexplained delay of twenty two days, in as much as, while the occurrence took place on 08.07.2025, the F.I.R was lodged on 30.07.2025. Further, the victim refused her medical examination and her age in her statement has been recorded as seventeen years which is almost on the verge of majority stating therein that her brother-in-law and his younger brother i.e. the petitioner took her to their house where she was kept. However, there is no allegation of any sexual assault etc. The petitioner is in custody since 02.08.2025 with no criminal antecedent.

5. Learned APP for the State and learned counsel for the informant opposed the bail petition on the ground that victim was a minor girl who was kidnapped by the petitioner and other.

Taking into consideration the facts and circumstances of the case and also considering the unexplained delay of about twenty two days in lodging of the First Information Report and the petitioner also being related to the informant and the victim with no allegation of any sexual assault etc., the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs10,000/- (Rupees

No.73672 of 2025(4) dt.23-02-2026 3/3 Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Choutarwa P.S. Case No. 240 of 2025, subject to the condition that : (i) The petitioner shall remain physically present in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reasons, his bail bonds shall be liable to be cancelled by the learned court concerned.
