The petitioner seeks bail in Bath P.S. Case No. 55 of 2015 registered for the offence punishable under Sections 363 and 365 of the Indian Penal Code.
Informant is the wife of victim who in her statement has stated that petitioners and others had kidnapped her-husband at the instance of Dr. Anil Kumar who had provided loan of Rs. 5 Lacs to her husband as a consideration money for land and thereafter a demand was made to refund the amount and informant refunded amount of Rs. 3.50 Lacs to said Dr. Anil Kumar but still his victim-husband was not released. However subsequently he came to the house and his statement was recorded by the police as well under Section 164 of the Cr.P.C.
Patna High Court Cr.Misc. No.14671 of 2018(3) dt.09-04-2018 2/2 It has been contended that similarly placed persons have already been granted bail by a co-ordinate bench of this Court which has been annexed as Annexure-3 to this petition. Petitioner has got no criminal antecedent and is in custody since 05.12.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XIIIrd, Bhagalpur in connection with Bath P.S.
