The petitioner seeks bail in Sangrampur P.S. Case No. 182 of 2017 registered for the offence punishable under Sections 341, 323, 324, 379, 354, 307 and 504 of the Indian Penal Code.
Informant is the wife of victim who in her written complaint has stated that on 24.10.2017 the accused-petitioner with other family members entered into the house and started abusing her then the husband of the informant tried to prevent the accused persons from using filthy language, whereupon the accused-petitioner having scissor in his hand assaulted her husband on chest and also snatched mangalsutra from the neck
Patna High Court Cr.Misc. No.14737 of 2018(3) dt.09-04-2018 2/2 of the informant and thereafter fled away. Victim was taken to the hospital for treatment and as per injury report incised wound of 1x1/2 inch was found caused by sharp cutting weapon. It has been submitted on behalf of the petitioner that there is dispute regarding partition between the parties and petitioner has got no criminal antecedent and is in custody since 25.10.2017.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate at Motihari, East Champaran, in connection with Sangrampur P.S.
