JUSTICE ARUN KUMAR ORAL ORDER 29-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 6.8.2017, seeks bail in Khagaria (Chitragupta Nagar) PS Case No. 529 of 2017 registered under Sections 392, 402 of the IPC and Section 25(1-b)a, 26 and 35 of the Arms Act.

The allegation in brief is that several persons were apprehended and arms were recovered from possession of many of them, one country made pistol with two live cartridges were recovered from the possession of the petitioner. Learned Counsel for the petitioner submits that the petitioner is in custody since 6.8.2017 and only after his arrest in the present case the police also implicated him in another case and except that there is no other case against the petitioner, more over similarly situated another co-accused Gunjan Singh has been admitted to bail by a coordinate Bench of this Court.

Having considered the said facts and circumstances, the petitioner, namely, Chetan Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Khagaria in connection with Khagaria (Chitragupta Nagar) PS Case No. 528 of 2017.
