Petitioner seeks bail in a case registered for the offences punishable under Sections 8,20,(b)(ii)(c),25,27 of the N.D.P.S. Act.
Submission is that co-accused Raj Kumar Gupta having similar allegation has been granted bail by a Coordinate Bench of this Court in Cr.Misc.No.1010 of 2018 by a reasoned order and the case of the petitioner is on better footing, as the petitioner had already let-out the said shop in the month of April, 2017 to his neighbour Bechani Kuer vide written agreement at Annexure-2. Hence, anything which was recovered from the old shop of the petitioner was in fact shop of Bechani Kuer.
Patna High Court Cr.Misc. No.14491 of 2018 (2) dt.14-03-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with NDPS Case No.10 of 2017 arising out of Durgawati P.S.Case No.129 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
