The petitioner is languishing in custody in a case registered for the offences punishable under Sections 30(a), 32(i)(ii), 36, 41(i)(ii) of the Bihar Prohibition & Excise (Amendment ) Act, 2018.

There is recovery of 90 litres of Indian made Foreign Liquor from the car.

It is submitted by learned counsel for the petitioner that nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has no concern either with the seized car or

Patna High Court CR. MISC. No.74262 of 2022(2) dt.03-02-2023 2/2 the recovered country made liquor. The petitioner is languishing in custody since 16.11.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Judge, Excise, Nalanda at Biharsharif in connection with Rahaui (Bhaganbigha) P.S. Case No. 607 of 2022.
