The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.
Learned counsel for the petitioner submits that there is recovery of 172 liters of illegal bear from the back field of the house of co-accused and there is no recovery from the conscious possession of the petitioner. The petitioner has no criminal antecedent.
In the aforesaid facts and circumstances of the case, I am inclined to grant anticipatory bail to the above named petitioner, in the event of his arrest or surrender before the court
Patna High Court CR. MISC. No.73662 of 2019(2) dt.22-11-2019 2/2 below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge II cum Special Judge, Excise Act, Begusarai, in connection with Case No.150 C2 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
Subject to further condition is that the petitioner shall deposit Rs. 15,000/- in the Patna High Court Legal Services Committee, Patna.
