Petitioner seeks bail in a case registered for the offences punishable under Sections 399,402,414 of the Indian Penal Code and Sections 25(1-b)a,26,35 of Arms Act. According to FIR, the police suspected that the FIR named accused persons were preparing to commit dacoity. From possession of the petitioner, only a mobile phone was recovered. The petitioner has stated on oath that he has got no criminal antecedent.

Submission is that there is no material that the preparation was to commit dacoity only. Hence, no offence is made out against the petitioner.

Considering the aforesaid facts, let the

Patna High Court Cr.Misc. No.14520 of 2018 (2) dt.14-03-2018 petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Tekari (Panchanpur O.P.) Police Station Case No.510 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
