JUSTICE MOHIT KUMAR SHAH ORAL ORDER 14-05-2024 The present writ petition has been filed seeking the following reliefs:- "1.(i) For issuance of an order, direction or an appropriate writ upon the respondents to actually remove the encroachment made on the Govt.

Community Hall (Samudaik Bhawan) situated in Village+Post Mishrauliya, P.S. + Circle -Babubarhi, District Madhubani, Bihar which also includes land acquired by the petitioner through Basgit parcha in the year

Patna High Court CWJC No.16641 of 2023(2) dt.14-05-2024 2/3 1969-70 encroachment free.

(ii) For a direction upon the respondents to specially respondent no. 3 to make an independent enquiry with regard to encroachment on the land in dispute by few influential persons of the locality in connivance with the persons in authority.

(iii) For a direction or pass an appropriate writ commanding the respondents to ensure encroachment free and peaceful procession of the land in dispute for the petitioner and the co-villagers."

At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the District Magistrate, Madhubani i.e. the respondent no. 3 for redressal of his aforesaid grievances. Liberty, so sought, is granted.

It is needless to state that in case the petitioner approaches District Magistrate, Madhubani i.e. the respondent no. 3, by filing appropriate representation, within a period of two weeks from today, the same shall be disposed of by a reasoned and a speaking order, in accordance

The writ petition stands disposed of on the aforesaid terms.
