JUSTICE ARUN KUMAR ORAL ORDER 03-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody since 26.11.2017, seeks bail in connection with POCSO Case No. 91 of 2017 arising out of Kargahar P.S.Case No. 335 of 2017 registered under Sections 366A and 376 of the Indian penal Code and 4 of the Prevention of Children from Sexual Offences Act.

Allegation in brief is that 17 years old daughter of the informant was kidnapped by the petitioner 15 months ago and he sexually exploited her. After getting information, informant got her released with the help of villagers from the illegal confinement.

Submission is that no information was lodged prior to institution of the present case regarding missing of his daughter or kidnapping rather informant was pressurizing to marry with

Patna High Court Cr.Misc. No.18514 of 2018 (2) dt.03-04-2018 2/2 petitioner's daughter and upon refusal, this false case was instituted.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Kanhaiya Nut, is directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge, Rohtas at Sasaram in connection with POCSO Case No. 91 of 2017 arising out of Kargahar P.S.Case No. 335 of 2017.
