The petitioner seeks bail in connection with Rampur P.S. Case No. 404 of 2022 registered for the offence under Sections 414, 467, 468 and 420 of the Indian Penal Code. The accused/petitioner is named in the F.I.R. and is in custody since 07.08.2022.
The allegation against the petitioner is to have in possession of one motorcycle alleged to be stolen and belongs to one Raju Prasad Soni, as per FIR.
Learned counsel appearing on behalf of the petitioner submitted that alleged stolen motorcycle not appears to be recovered from possession of this petitioner. It is submitted that as petitioner found involved in 05 more criminal cases of similar
Patna High Court CR. MISC. No.74657 of 2022(2) dt.22-03-2023 2/2 nature, due to which, suspicion arises out of those criminal antecedents, petitioner apprehended in the present case without having any connecting evidence. It is also pointed out by learned counsel that this petitioner is on bail in all those 05 criminal cases. While concluding the argument, it is submitted that investigation of this case has already completed, for which, charge-sheet has already submitted, as such, there is no chance of tampering with the evidence.
Learned APP appearing on behalf of the State, opposes the prayer of bail.
Considering the facts and circumstances as mentioned above and by taking note of allegation, where, petitioner is in custody since 07.08.2022 coupled with the fact that charge-sheet has already been submitted, let the petitioner, above named, is directed to be released on bail in connection with Rampur P.S. Case No. 404 of 2022, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Gaya/concerned court, subject to the condition as mentioned under Section 437(3) of the Cr.P.C.
