JUSTICE ARUN KUMAR ORAL ORDER 21-03-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Muzaffarpur Rail PS Case No. 179 of 2017 registered under Sections 401 and 414 of the IPC.

The allegation in brief is that the petitioner was apprehended from the railway platform and three mobiles, eighteen hundred rupees and a half blade were recovered from his possession. Learned Counsel for the petitioner submits that there is no allegation of committing theft, the articles recovered are personal belongings of the petitioner and he has no criminal antecedent, moreover he is in custody since 22.12.2017.

Having considered the said facts and circumstances, the petitioner, namely, Md. Firoj @ Md. Firoj Khan is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of ACJM (Railway), Sonepur, Saran in connection with Muzaffarpur Rail PS Case No. 179 of 2017.
