JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 28-03-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner is accused in connection with Sugauli P.S. Case No. 47 of 2018 registered under Section 30(a) of the Bihar Excise Act, 2016.

The accusation is of recovery of 10 litres country made liquor to the house of the petitioner.

Learned counsel for the petitioner submits that petitioner was not apprehended at the spot and, later on, he has surrendered before the trial court on 12.02.2018 since then he is in custody. It is further submitted that petitioner has no criminal antecedent.

No.17397 of 2018 (2) dt.28-03-2018 Having regard to the facts and the circumstances of the case, the petitioner above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Jude-IV-cum- Special Judge, Excise, East Champaran, Motihari, in connection with Sugauli P.S. Case No. 47 of 2018.
