Petitioners, already in custody, seek bail in connection with Piprakothi P.S. Case No.201 of 2017, registered under Sections 399 and 402 of the Indian Penal Code as well as under Sections 25(1-b)A, 26, 35 of the Arms Act.
Large number of criminals were apprehended by the police and number of arms and cartridges were recovered from their possession and from petitioner no.1 one knife and from petitioner no.2 one loaded country made pistol were recovered. It is submitted that it is a case of false implication and except one criminal antecedent the petitioners have no other antecedent, both are in custody since 09.10.2017 and
Patna High Court Cr.Misc. No.17402 of 2018(2) dt.27-03-2018 2/2 investigation has been completed.
Having considered the aforesaid facts and circumstances, the prayer of bail of the petitioners is rejected. However, the petitioners may renew their prayer of bail after framing of the charge.
