2. The petitioner seeks regular bail in connection with Chiraiya P.S. Case No. 382 of 2023 dated 10.08.2023, lodged under Sections 399 and 402 of the I.P.C. read with Sections 25(1-b)a, 26 and 35 of the Arms Act.

3. As per the prosecution case, the petitioner was caught planning a loot. One country-made pistol and one cartridge was recovered from him.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He further submits that petitioner is in custody since 10.08.2023 having 13 criminal antecedents which are serious in nature.

5. Learned A.P.P. for the State opposes the prayer for

Patna High Court CR. MISC. No.78538 of 2023(4) dt.29-02-2024 2/2 bail and submits that the petitioner was planning for a loot, which is heinous crime.

6. Considering the antecedent of the petitioner, I am not inclined to grant bail to him and therefore, his bail petition is hereby rejected.

7. The Trial Court is directed to expedite the trial as early as possible.

8. If trial is delayed, the petitioner may renew his prayer for bail.
