2. Petitioner seeks regular bail in case registered for the offences punishable under Sections 103 and 61(2) of the B.N.S. and Section 27 of the Arms Act.
3 . The prosecution case , in brief, is that informant namely , Rinku devi alleged that on 20.07.2025 at about 09:50 PM, co-accused Gautam Thakur came and fired upon the chest of husband of informant, due to which he sustained firearms injury and on way to the hospital, husband of the informant died. It is further alleged that this petitioner and other coaccused persons were also present at the place of occurrence .
4. Learned counsel for the petitioner submitted that
Patna High Court CR. MISC. No.76225 of 2025(2) dt.18-11-2025 2/2 from bare perusal of F.I.R. it is apparent that specific accusation for firing is against co-accused Gautam Thakur. So far as this petitioner is concerned, he is only alleged to be present on the place of occurrence sitting on a motorcycle and fled away after the alleged occurrence . Petitioner claims clean antecedent and is in custody since 23.07.2025 .
5 . Learned A.P.P. for the State vehemently opposes the bail application.
6. Considering the aforesaid facts, materials available on record, period of custody , clean antecedent of this petitioner and other circumstances of the case , the bail application is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Pandaul P. S. Case No. 162 of 2025 .
