Petitioner seeks bail in a case registered for the offences punishable under Sections 341,323,379,302/34 of the Indian Penal Code.

This is a case of misuse of privilege of bail. Bail bond was cancelled on 2.9.2009. Thereafter, the petitioner is in custody since 12.01.2018. The impugned order would reveal that liberty was allowed to renew prayer after six months, if the trial is not concluded in the meantime.

Learned counsel for the petitioner submits that charge has already been framed and there is no chance of conclusion of the trial within aforesaid period.

No.21990 of 2018 (2) dt.20-04-2018 Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with S.T.No.316 of 2008 arising out of S.Kamal Police Station Case No.29 of 2005, subject to the condition that the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
