====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR JHA ORAL ORDER 22-01-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.
2. In the present case, the petitioner seeks bail in connection with Dariyapur P.S. Case No. 292 of 2024, registered for the offences under Sections 302, 304(B), 201 and 34 of the Indian Penal Code.
3. As per the prosecution case, petitioner is husband of the deceased sister of the informant and allegation is that of causing dowry death of the sister of the informant against the petitioner and others.
4. Learned counsel appearing on behalf of the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. No occurrence as alleged has ever taken place. The wife of the petitioner died due to illness
Patna High Court CR. MISC. No.77705 of 2024(3) dt.22-01-2025 2/3 and the family members of the petitioner gave information to the informant and her family about death of the wife of the petitioner. The family members of the deceased came and participated in the last rites but the present case has been lodged as an afterthought by the informant to extort money from the petitioner. The allegation is quite general and vague and there is no eye witness to the alleged occurrence. Charge sheet has been submitted against the petitioner and he is in custody since 29.05.2024. The petitioner is having no criminal antecedent.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.

Having regard to the fact and circumstances and submission made on behalf of the parties and considering the lack of substantive material to connect the petitioner with the offences as alleged and further considering period of custody and submission of charge sheet against the petitioner and his clean antecedent, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Saran at Chapra/concerned court, in connection with Dariyapur P.S. Case No. 292 of 2024, subject to the condition laid down under Section 437(3) of the code of
Patna High Court CR. MISC. No.77705 of 2024(3) dt.22-01-2025 3/3 Criminal Procedure and other following conditions: (i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
