2. The petitioner seeks bail in connection with Nawada Cyber P.S. Case No. 110/2025, registered for the offence under Sections 303(2), 318(2), 318(4), 319(2), 336(2), 336(3), 338, 340(2), 111, 317(5) and 61(2) of the BNS and Sections 66, 66(B), 66(C),66(D) of the I.T. Act.

3. The accused/petitioner is not named in the F.I.R. and is in custody since 16.07.2025.

4. As per FIR, on suspicion a raid was conducted by the informant, who is Sub-inspector of Cyber Police Station Nawada, where during raid several electronic gadgets i.e. mobile phone, ATM card, Aadhar card, passbooks of different banks said to be recovered and a suspicion was raised that

Learned counsel appearing on behalf of the petitioner submitted that the name of petitioner transpired on the basis of confessional statement of co-accused, namely, Manish and Sudhanshu during course of investigation, where in furtherance of which no incriminating material appears to be recovered from this petitioner, which may suggest his involvement prima facie with crime in question. While concluding the argument, it is submitted that investigation of this case is already completed, for which charge-sheet has been submitted, as such, there is no chance of tampering with the evidence. Petitioner claimed clean antecedent.

6. Learned APP opposed the prayer of bail.

Considering the aforesaid factual submissions and by taking note of fact as prima facie nothing incriminating appears recovered from possession of this petitioner to suggest his involvement with alleged crime in question, coupled with the fact that investigation of this case is already completed, where petitioner remains in custody since

Case No. 110/2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VI, Nawada/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
