JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 2.3.2017 passed in Cr.Misc.No. 7651 of 2017 with a direction to learned trial court to expedite the trial and try to conclude it within a period of nine months and if not petitioner was given liberty to renew his prayer for bail before the court below itself.

Submission of learned counsel for the petitioner is that period of nine months has already expired and trial has not been concluded.

Heard learned APP also and perused the report from which it appears that the case is pending only for evidence of Dr. Bhavesh Kumar and learned trial court has already been granted three months extended period to conclude the trial and trial court

Patna High Court Cr.Misc. No.7355 of 2018 (3) dt.07-03-2018 2/2 assured that trial will be concluded within the extended period. Having heard both sides and in the facts and circumstances, I am not inclined to grant bail to the petitioner. Hence, prayer for bail is rejected.

However, learned trial court is directed to expedite the trial and conclude it within the extended period. With the above observation, this application is dismissed. (Vinod Kumar Sinha, J) spal/- U
