ANJANA MISHRA ORAL ORDER 15-05-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 23.09.2017 in connection with S.T. No.29 of 2018, arising out of Kodhobari P.S. Case No.23 of 2017, registered for the offence under Section 304B/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
Learned counsel for the petitioner submits that the petitioner is a co-villager of the family of the deceased lady, who has allegedly been done to death by the family members in connection with the demand for dowry.
So far as the present petitioner is concerned, it is submitted that the provisions of Section 304B I.P.C. would not
Patna High Court Cr.Misc. No.25074 of 2018 (2) dt.15-05-2018 2/2 attracted in his case and the allegations levelled against him are also general and omnibus in nature. It is further submitted that the petitioner has already been in custody for more than six months.
In view of the aforementioned facts and circumstances and that the petitioner is not being a family member, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge I/C, Kishanganj, in connection S.T. No.29 of 2018, arising out of Kodhobari P.S. Case No.23 of 2017. (Anjana Mishra, J) PNM U T
