The petitioner seeks pre-arrest bail in connection with Muffasil P.S. Case No. 372 of 2019, registered under Section 366A/34 of the Indian Penal Code.
The accusation is of enticing away the daughter of the informant, aged about 16 years, by the petitioner for the purpose of marriage with the help of his family members. Submission is that in fact daughter of the informant was major at the time of alleged occurrence and she left her parental house, according to her own sweet will, and the statement of the daughter of the informant was recorded under Section164 of the Criminal Procedure Code on 22.07.2019 in which she detailed her age 20 years and her age was assessed as
Patna High Court CR. MISC. No.67847 of 2019(2) dt.31-01-2020 2/2 22 years and she stated about performing marriage with the petitioner, which would appear from Annexure 2. Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Muffasil P.S. Case No. 372 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
