The petitioner seeks bail in a case registered under Sections 379, 411 of the Indian Penal Code.

Allegation is that the petitioner committed theft of mobile of the petitioner and fled away.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 15.07.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been made accused due to mistake of fact. The allegation of theft of a mobile is denied by the petitioner. The petitioner has remained in custody for reasonable period. The case is triable by the Magistrate.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Kiul (Lakhisarai) in Kiul Rail P.S. case No.129 of 2019.
