The petitioner apprehends his arrest in connection with Khajauli P.S. Case No.70 of 2017 registered under Sections 341, 323, 324, 307, 504/34 of the Indian Penal Code. Learned counsel for the petitioner submits that it is case of false implication of the petitioner.

Learned APP for the State opposed the prayer for anticipatory bail stating that there are specific allegations of giving repeated knife blow by this petitioner and, therefore, he does not deserve privilege of anticipatory bail.

Considering the facts and circumstances of the case particularly that there are specific allegations of assault against

Patna High Court Cr.Misc. No.7166 of 2018 (2) dt.20-02-2018 this petitioner, I am not inclined to grant anticipatory bail to the petitioner.

The application is dismissed.

At this stage, learned counsel for the petitioner seeks liberty for the petitioner to surrender in the court below within four weeks from today and pray for regular bail. If the petitioner surrenders in the court below within four weeks from today and prays for regular bail, then the same shall be considered by the learned court below on its own merit without being prejudiced by the present order of this Court.
