Petitioner apprehends his arrest in connection with Bachwara P.S. Case No.195 of 2018 for the offence punishable under Sections 30 and 32 of the Bihar Prohibition & Excise Act. The accusation is that, on receiving secret information about carrying of liquor near Barkhut river, the informant along with other police personnel reached there. On seeing the police party, some persons started to flee away but on chased, one person was apprehended, who disclosed his name as Raj Kumar Pandit, while two persons succeeded to flee away. The local Choukiar identified two persons who succeeded to flee away as Dharmendra Kumar Singh (petitioner) and Sudhir Mahto. On

Patna High Court CR. MISC. No.73121 of 2019(2) dt.21-11-2019 2/2 search, three sacks each containing 144 bottles of 180 ml Indian made foreign liquor were recovered.

Learned counsel for the petitioner submits that petitioner was not apprehended on the spot and his name has been disclosed by local Choukidar due to dirty village politics. Further submission is that petitioner has no criminal antecedent. Having regard to the facts and circumstances of the case, let the above named petitioner, Dharmendra Kumar Singh @ Dharmendra Kumar, be released on bail, in the event of prearrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge-cum-Special Judge, Excise, Begusarai, in connection with Bachhwara P.S. Case No.195 of 2018, subject to the condition as laid down under Section 438 (2) of Cr.P.C. (Rajendra Kumar Mishra, J) sanjeev/- U T
