====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 14-11-2024 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Kankarbagh P.S. Case No. 669 of 2024 registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.

3. Allegation is recovery of 10 liters of country made liquor from the house of the petitioner.

4. It is submitted by learned counsel for the petitioner that the petitioner is quite innocent and has committed no offence. No such occurrence as alleged has ever taken place. Local people disclosed that the said house belongs to the petitioner. No incriminating article has been recovered from conscious possession of the petitioner. It is further submitted

5. Learned APP for the State opposes the prayer for bail and submits that the alleged recovery has been made from the house of the petitioner.

6. Considering the facts and circumstances of the case as well as the submissions of learned A.P.P., I am not inclined to enlarge the petitioner on anticipatory bail. The prayer for anticipatory bail of the petitioner is hereby rejected.
