JUSTICE ARUN KUMAR ORAL ORDER 02-02-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Assaon P.S.Case No. 48 of 2017 registered under Sections 272, 273 and 308 of the Indian penal Code and Section 30(a) and 38(b) of Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner is not named in the FIR and recovery is also not from the possession of the petitioner rather it is from a school of Dhananjay Ojha runs in the premises of Sidheswar Pathak and co-accused Sidheswar Pathak has been admitted to bail by a co-ordinate Bench of this Court vide order dated 17.10.2017 passed in Cr. Misc. No. 46146 of 2017.

Having considered the aforesaid facts and circumstances, the petitioner, namely, Sachitanand Pandey, is directed to be

Patna High Court Cr.Misc. No.6075 of 2018 (2) dt.02-02-2018 2/2 released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Siwan in connection with Assaon P.S. Case No. 48 of 2017.
