JUSTICE SANJAY PRIYA ORAL ORDER 11-04-2018 Heard learned counsel for the petitioner and the State. Prayer for bail of this petitioner was earlier rejected by this Court vide order dated 18.07.2017 passed in Cr. Misc. 24321 of 2017 with liberty to the petitioner to renew his prayer for bail in the court below itself after six months if no substantive progress is made in the case.

The petitioner has renewed his prayer for bail in the court below.

From the impugned order it appears that after framing of charge, no witness has been examined in this case. Learned counsel for the petitioner has submitted that petitioner is in custody since 12.04.2017.

Keeping in view the period spent by the petitioner in

Patna High Court Cr.Misc. No.15225 of 2018 (2) dt.11-04-2018 2/2 custody, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Railway, Gaya, in connection with G.R.P.S. Gaya Rail P.S. Case No. 101 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner. (Sanjay Priya, J) S.Ali/- U T
