2. The petitioner makes a prayer for regular bail in connection with Narahiya P.S. Case No.95 of 2024, F.I.R dated 19.12.2024 registered for the offences punishable under Sections 137(2), 140(2), 352 and 3(5) of the B.N.S., 2023.
3. As per the prosecution case, the informant, Kalu, a pickup driver, reported to Narahiya Police Station on 19.12.2024 that while traveling from Siliguri to Jaipur with his co-driver Sikandar @ Samir, six unknown persons on two motorcycles intercepted them on NH-57. The miscreants abused them, forcibly took away his co-driver along with his personal belongings, and fled. The informant suspects kidnapping and

Learned counsel for the petitioner submits that from the confessional statement of one Satyendra Kumar Yadav, the name of the petitioner has transpired in this case while no cogent material has surfaced on record during the course of investigation to prove the complicity of the petitioner in the said case. It has next been submitted that the victim upon recovery, has not stated anything against this petitioner while getting the statement recorded under Section 180 of the B.N.S., whereas, the statement of the witness only supports the factum of occurrence while nothing has been said by any of the witnesses against this petitioner. The investigation has already been completed and charge-sheet has also been filed and the petitioner is languishing in custody since 18.06.2025. Lastly, it has been submitted that the petitioner has three criminal antecedent which is not akin to the instant case.
5. Learned Additional Public Prosecutor for the State opposes the prayer for regular bail.
6. Considering the facts and circumstances that nothing incriminating has surfaced during the course of investigation and the victim has not taken the name of the petitioner and the petitioner being in judicial custody since

No.78420 of 2025(5) dt.19-03-2026 3/3 18.06.2025, the petitioner is enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount, each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Jhanjharpur, District Madhubani, in connection with Narahiya P.S. Case No.95 of 2024, subject to the condition that the petitioner shall co-operate in the investigation/trial.
