JUSTICE ARUN KUMAR ORAL ORDER 05-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 5.2.2018, seeks bail in K.Hat (Sahayak) PS Case No. 940 of 2017 registered under Sections 356 and 379 of the IPC.

The allegation in brief is that the informant's mobile was snatched away by two motorcycle borne miscreants. Learned Counsel for the petitioner submits that the petitioner had purchased the mobile from one Zulfikar but he did not hand over the paper so the mobile was returned back by the petitioner after two days but in the meanwhile he had used his sim in the said mobile and that is the evidence against the petitioner, whereas the mobile was recovered from Zulfikar. It is also submitted that the petitioner has no criminal antecedent.

Having considered the said facts and circumstances, the petitioner, namely, Vishnu Sardar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Purnea in connection with K.Hat (Sahayak) PS Case No. 940 of 2017.
