2. The petitioner apprehends his arrest in a case registered under Sections 341, 323, 324, 307, 302, 504 and 34 of the Indian Penal Code.
3. As per F.I.R., co-accused Indrajeet Kumar @ Indrajeet Rai caught the hand of the brother of informant/deceased and other accused persons assaulted the deceased with lathi.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to previous dispute. Further submission is that though petitioner is named in the FIR but no specific accusation is against the petitioner. Allegation of assault
Patna High Court CR. MISC. No.80218 of 2024(2) dt.21-01-2025 2/2 is against other accused persons. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State and learned counsel for the informant opposed the prayer for bail.
6. Having considered the aforesaid facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Samastipur in connection with Kalyanpur P.S. Case No. 103 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
