Petitioners seek regular bail in connection with Noorsarai P.S. Case No.288 of 2019, for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

The allegation against the petitioners is that the police intercepted a car from where two persons came out and tried to flee away and were arrested by the police and upon search being made, police recovered a total quantity of 67.125 litres of illicit liquor from the dickey of the car.

Learned counsel for the petitioners submits that the

Patna High Court CR. MISC. No.69163 of 2019(2) dt.04-12-2019 2/2 petitioners have got no criminal antecedent and the car from where the illicit liquor has been recovered does not belong to the petitioners. Learned counsel further submits that the petitioners are in custody since 21.09.2019.

Having regard to the submissions made by the parties and taking into consideration the fact that petitioners have got no criminal antecedent and car from where the illicit liquor has been recovered does not belong to the petitioner and he is in custody since 21.09.2019, I am inclined to grant regular bail to both the petitioners. Accordingly, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (twenty five thousand) each with two sureties of the like amount each to the satisfaction of learned 3rd Additional District & Sessions Judge-cum-Special Judge, Excise, Nalanda at Bihar Sharif, in connection with Noorsarai P.S. Case No.288 of 2019.
