In this case, the petitioner is seeking regular bail in connection with Kharagpur P.S. Case No. 60 of 2022, registered for the offences punishable under Sections 302, 201, 120(B), 427 of the IPC.

The prosecution case in brief is that Md. Sajjad, who is brother of the informant went with his magic vehicle with one Md. Kausar. On 09.02.2022, at about 9:30 a.m., the informant came to know that the dead body of his brother and Md. Kausar were lying near Rishikund Pahar. He expressed his firm belief that co-accused Md. Mansoor, Md. Firdaus, Md. Ibran and Md. Rizwan, in a deep conspiracy, had killed his brother and burnt

The learned counsel for the petitioner has submitted that the petitioner is innocent. He is not named in the FIR. His name has figured in confessional statement of co-accused Ranjeet Kumar and expect this, there is nothing against him. On the other hand, the learned APP, Sri Shailendra Kumar has opposed the prayer for bail and submitted that an independent witness, who is also an eye-witness, has stated in paragraph no. 15 of the case diary that he saw the petitioner and other accused persons were assaulting two persons and they burnt the pickup vehicle. He has submitted further that as many as five injuries were found on the person of Md. Sajjad (deceased).

In my view, the petitioner does not deserve the privileges for bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Kundan/Nirmal U T
