Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code.

Both sides are agnate. On suspicion that the petitioner's side had stolen the motorcycle of the informant, an occurrence of abuse and assault started, wherein co-accused Md. Jafir caused dagger blow to Md. Kasim as a result whereof he died. Allegation against the petitioner is of commission of assault with lathi.

Considering the nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties

Patna High Court Cr.Misc. No.12672 of 2018 (2) dt.06-03-2018 2/2 of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Cheriya Bariyarpur Police Station Case No. 89 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
