Petitioner seeks bail in a case registered for the offences punishable under Sections 409 and 420 of the Indian Penal Code.

Submission is that the petitioner was Headmaster of the school where construction of building was going on, there was a dispute regarding road by the villagers and, hence, there is delay in completion of work. Allegation is that he misappropriated the remaining amount.

Submission is that after lodging of the FIR, petitioner has already completed the construction which would be evident from the certificate granted vide Annexure-2 and 3.

No.8017 of 2018 (2) dt.09-02-2018 2/2 Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Alauli Police Station Case No. 164 of 2015, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
