2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 304(B) and 120(B) of the Indian Penal Code.

3. The case of the prosecution is that the daughter of the informant namely, Raushni Kumari was married to the petitioner in the year 2022. It is also alleged that she was being subjected to cruelty on account of non-fulfillment of dowry demand. It is further alleged that on 23.06.2024 at 11:28 PM, the father-in-law of Raushni Kumari informed the informant that she is ill.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He has got no criminal antecedent. He also submits that it is a case of hanging, which will transpire from the photograph, which is annexed of the place of

Patna High Court CR. MISC. No.81262 of 2024(5) dt.08-04-2025 2/2 the occurrence. It is further submitted that the petitioner is languishing in judicial custody since 28.06.2024.

Learned APP appearing for the state has opposed the prayer of regular bail and submits that in this case, at 11:28 PM, the informant was informed that his daughter is ill whereas when the informant consulted the doctor, he was informed that Raushni Kumari was brought dead at 09:30 PM. From perusal of the postmortem report, it transpires that on the person of the deceased, there were four ante-mortem injuries. One is ligature mark and three injuries are bruise mark on different parts of the body. From perusal of the postmortem report, it transpires that it is not a case of hanging. Petitioner is the husband and the main thrust of allegation is against him.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is not inclined to enlarge the petitioner on bail at this stage, as such, the prayer for bail stands rejected.

7. However, the petitioner will be at liberty to renew his prayer for bail after six months.
