The petitioners, who are in custody, seeks bail in connection with Thakaraha P.S. Case No. 235 of 2017 registered for the offence punishable under Sections 147, 148, 149, 323, 324, 307 and 302 of the Indian Penal Code.
Informant is the father of deceased, who in his written complaint has stated that on 24.11.2017 at about 12.00 o' clock he was cultivating his field and the petitioners encroached over homestead land and when he objected then the accused persons including the petitioners variously armed
Patna High Court Cr.Misc. No.15372 of 2018(5) dt.13-04-2018 2/2 with lathi, danda and hockey assaulted his younger brother Chhote Lal Yadav. Ramanand Yadav assaulted by iron rod over the head of his younger brother and he fell down. When he went to resolve the issue all the five accused persons assaulted him and when villagers assembled there all fled away. There is general and omnibus allegation against the petitioners and there is no specific overt act alleged against the petitioner by the informant. Petitioners are in custody since 30.11.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., 1st Bagha, District- West Champaran, in connection with Thakaraha P.S.
