The petitioner has prayed for bail in a case registered for the offence punishable under sections 420, 467, 468, 471, 120(B) of the Indian Penal Code and Section 30(a), 31, 41(i) of the Bihar Prohibition and Excise Act.

Prosecution case relates to recovery of 7127.280 litres of illicit liquor from a ten wheeler Tata Mahindra during vehicle checking and driver and co-driver both were arrested on spot. They disclosed the name of Krishna Yadav and thereafter he disclosed the name of the present petitioner. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner is proprietor of Distillery Company in

No.75870 of 2023(2) dt.30-11-2023 2/2 Arunachal Pradesh in name and style of M/S Pristine Distilleries having license of blending and packaging of wine given by the govt. of Arunachal Pradesh. He was no concern with the seized wine from state of Bihar. In fact, he is not named in the FIR. He is languishing in judicial custody since 17.10.2023. Learned APP appearing for the State has opposed the prayer of Bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-II-cum-Special Judge Excise, Kishanganj in connection with Kochadhaman P.S. Case No. 152 of 2022.
