The petitioner seeks bail in a case registered for offences punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30 (a), 38 and 47 of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 12 litres foreign liquor was recovered from a motorcycle. The petitioner along with other person was allegedly driving the said motorcycle but seeing the police party, they manged to escape. It is further contended that the petitioner was not apprehended on the spot and due to village politics, he has been implicated in this case. Petitioner claims that he is having clean antecedent and is in custody since 25.02.2018.

No.20128 of 2018(2) dt.19-04-2018 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioner is directed to be released on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 3rd Additional Sessions Judge-cum-Special Judge, Excise Act, Samastipur in connection with Kalyanpur P.S. Case No. 01 of 2018.

Further, if the petitioner, after his release in this case, is again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of his bail bond.
