Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 307, 302 and 504 of the Indian Penal Code.

Submission is that in the FIR, allegation of commission of murder is against co-accused Farooque Mian. Allegation against the petitioner is of commission of assault with lathi to one Jalil Mian who is not the deceased of this case. Petitioner is in custody since 21.12.2017. Investigation of the case is already complete.

Considering the nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties

Patna High Court Cr.Misc. No.20662 of 2018 (2) dt.17-04-2018 2/2 of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhangaha Police Station Case No. 36 of 2016, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
