The petitioner seeks bail in a case instituted for the offences under Sections-341, 323, 290, 504 of the IPC and Section-37 of the Bihar Prohibition and Excise Act, 2016.

The petitioner is alleged to have consumed liquor. It has been submitted on behalf of the petitioner that due to mistake of fact, the petitioner has been made accused in the present case. The allegation made is denied by the petitioner. The petitioner is in custody since 02-09-2017.

Chargesheet/prosecution report has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. It is alleged that the petitioner was apprehended in

Patna High Court Cr.Misc. No.15525 of 2018 (2) dt.19-03-2018 drunken state.

On behalf of the State, it is submitted that the petitioner is named in the F.I.R/complaint case.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge-cum-Special Judge, Excise Act, Purnea in connection with K.
