JUSTICE VINOD KUMAR SINHA ORAL ORDER 27-11-2019 Petitioner seeks bail in connection with Kanti P.S. Case No. 646 of 2019 registered for the offences punishable under Sections 411, 412 and 413/34 of the Indian Penal Code. As per FIR two motorcycles were intercepted by police, one of which was without number plate and petitioner and other accused persons were arrested, who could not produce the paper of the motorcycles.
Submission of learned counsel for the petitioner is that one of the motorcycles belongs to one Vikash Kumar, who has filed photo copy of registration number of motorcycle, Annexure-2 and Vikash Kumar has filed an affidavit that he has given it to the petitioner. It has also been submitted that petitioner has no criminal antecedent and he is in custody since
Patna High Court CR. MISC. No.68335 of 2019(2) dt.27-11-2019 2/2 28.8.2019 and charge sheet has been submitted. Heard learned APP also.
In view of above facts and circumstances, let petitioner be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the S.D.J.M.(West), Muzaffarpur, in connection with Kanti P.S. Case No. 646 of 2019, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
