JUSTICE ASHUTOSH KUMAR ORAL ORDER 16-03-2020 The petitioner, who is in custody since 26.05.2019, seeks bail in connection with Sessions Trial No. 537 of 2019 arising out of Garkkha P.S. Case No. 300 of 2019, dated 25.05.2019, instituted for the offence under Sections 341, 324, 326 and 302 read with 34 of the Indian Penal Code.

One Avinash is said to have given a knife blow to the son of the deceased leading to his death. The petitioner and two other persons are said to have caught hold of the deceased when he was being attacked. Aforesaid Avinash has been declared to be a juvenile. Patna High Court CR. MISC. No.78483 of 2019(4) dt.16-03-2020 2/2 accusation against them have been granted bail by a Bench of this Court vide order dated 28.08.2019 passed in Criminal Misc. No. 54159 of 2019.

It has further been submitted that the deceased died because of injury caused by a hard and blunt substance.

Considering all these facts and taking into account period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 5th Additional Sessions Judge, Saran at Chapra in connection with Sessions Trial No. 537 of 2019 arising out of Garkkha P.S. Case No. 300 of 2019.

The application stands allowed.
