Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 3.5.2017 passed in Cr. Misc. No.17814 of 2017 with a direction to the learned trial court to expedite the trial and try to conclude it within a period of nine months.

Submission of the learned counsel for the petitioner is that the period of nine months has already expired and up-till-now the charge has been framed but no witness has been examined in this case, though he is accused in five other cases but he is on bail in those cases. He is in custody since 12.1.2017. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.11764 of 2018 (2) dt.07-03-2018 2/2 circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Sri Nayan Kumar, J.M. Ist class, Muzaffarpur in connection with Kurhani P.S.Case no.301 of 2016 dated 4.10.2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled.

With the aforesaid observation, this application is allowed.
