2. The petitioner apprehends his arrest in connection with Warisaliganj PS Case No. 308 of 2025 dated 10.06.2025, registered for the offences punishable under Sections 126(2), 329(3), 115(2), 74, 76, 110 and 118(1) read with Section 3(5) of the B.N.S., 2023. Later on Section 109 of the B.N.S., 2023 was also added.

3. The allegation against the petitioner is of causing assault to the informant and her family members along with other accused persons leading to serious injuries.

4. Learned Advocate appearing on behalf of the petitioner taking this Court through the FIR contended that save and except the fact that name of the petitioner is arrayed as an accused in this case, there is no allegation of any specific overt act

In fact, the petitioner being karta of the family, his name has been implicated in this case with a view to put pressure and wreak vengeance. The present case is a counter blast of the Warisaliganj P.S. Case No. 307 of 2025 instituted by one of the family member of the petitioner against the informant and others. The petitioner bears fair antecedent besides he is aged about 70 years and undertakes that he will fully cooperate in the proceeding.

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application.

Regard being had to the submissions advanced by the learned Advocates for the respective parties and considering the fact that there is no specific accusation against the petitioner besides he is a septuagenarian having fair antecedent as well as the factum of case and counter case, let the petitioner, above-named, be released on bail, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt / production of a copy of this order, upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial MagistrateIV, Nawadah, in connection with Warisaliganj PS Case No.

Patna High Court CR. MISC. No.74349 of 2025(2) dt.25-11-2025 3/3 308 of 2025, subject to the conditions laid down in Section 482(2) of the B.N.S.S., 2023, with the further condition that one of the bailors shall be the own / close family members of the petitioner.
