The petitioner seeks regular bail in connection with Barauni P.S.Case No.191 of 2019 dated 7.5.2019 registered for offences punishable under Sections 304(B), 120(B), 201 and 34 of the Indian Penal Code.

Petitioner is said to be husband and the allegation against him is of causing death of his wife.

Submission of the learned counsel for the petitioner is that she died due to illness and the same was informed to the family members of the deceased's maike and as they had not come the dead body was disposed of.

Heard learned A.P.P. who has opposed the prayer for bail stating that there is no materials available in the case diary,

Patna High Court CR. MISC. No.67996 of 2019(4) dt.05-02-2020 2/2 which shows that she was suffering from any illness. Petitioner is the husband. Death is within seven years of the marriage and without waiting for the informant, the dead body was disposed of..

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, the learned trial court is directed to expedite the trial .

With the aforesaid observation, this application is dismissed.
